Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website [www.departuredelco.com] (the "Site") operated by Departure LLC ("us", "we", or "our").

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site. By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site.

The content of the pages of this Site is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on this Site for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

2. Online Reservations

Our online reservation service is provided as a convenience to our customers. While we make every effort to honor all reservations, please note that a reservation does not guarantee seating. We reserve the right to seat walk-in customers at reserved tables if the reserved party is more than 15 minutes late without notifying us.

3. Online Ordering for Collection

By placing an order through our Site, you are offering to purchase a product for collection at our restaurant. All orders are subject to acceptance and availability. We reserve the right to refuse any order.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email is not an order confirmation or order acceptance from Departure LLC.

Acceptance of your order and the formation of the contract of sale between Departure LLC and you will take place when we send you an email confirming the items are ready for collection, unless we have notified you that we do not accept your order or you have cancelled it.

4. Pricing and Payment

All prices listed on the Site are in US Dollars. We reserve the right to change prices at any time without notice.

Payment for online orders must be made by credit or debit card at the time of the order. We accept Visa, MasterCard, American Express, Discover, and major digital wallets (Apple Pay, Google Pay).

5. Collection of Orders

When placing an online order, you will be asked to select a collection time. Please note that this time is an estimate, and while we strive to have your order ready at the specified time, delays may occur during busy periods.

You are responsible for collecting your order from our restaurant at 2 S Orange St., Media, PA 19063. Please bring a copy of your order confirmation (either printed or on your mobile device) when collecting your order.

6. Cancellations and Refunds

For reservations, we kindly request that you notify us of any cancellations at least 2 hours in advance.

For online orders, once an order has been placed and payment has been processed, it cannot be cancelled. In case of any issues with your order, please contact us immediately, and we will do our best to resolve the situation.

If you fail to collect your order within 1 hour of the specified collection time, we reserve the right to dispose of the order with no refund provided.

Refunds may be issued at our discretion and will be processed to the original method of payment.

7. Intellectual Property

The Site and its original content, features, and functionality are owned by Departure LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Our Site may contain links to third-party websites or services that are not owned or controlled by Departure LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Limitation of Liability

You agree to defend, indemnify and hold harmless Departure LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Site, or b) a breach of these Terms.

These Terms shall be governed and construed in accordance with the laws of Pennsylvania, United States, without regard to its conflict of law provisions.
